1. Definitions and Interpretation

These Terms of Service ("Terms") use specific words with defined meanings. Here is what each one means:

  • "Platform" refers to the website accessible at casinowhistle.com, including all subdomains, pages, features, and services provided thereunder.
  • "Operator" refers to the entity responsible for operating and maintaining the Platform.
  • "User" refers to any natural person who accesses, browses, or makes use of the Platform, whether or not they hold a registered account.
  • "Content" refers to any text, images, ratings, reviews, comments, or other material submitted to the Platform by a User.
  • "Representative Account" refers to a verified account held by an authorised agent of a casino operator for the purpose of responding to User reviews.

2. Acceptance of Terms

By accessing or using the Platform, you agree to these Terms in full. If you disagree with any part, stop using the Platform immediately.

We may update these Terms at any time by posting the revised version here. Continuing to use the Platform after changes are published counts as acceptance of the new Terms.

3. Eligibility

You must be at least 18 years old to use this Platform. If your local laws set a higher minimum age for accessing gambling-related information, that higher age applies instead.

By using the Platform, you confirm that you meet this age requirement. We do not knowingly collect data from anyone under the minimum age.

4. Nature of the Platform

CasinoWhistle is an informational review site. We do not operate, promote, or endorse any casino, sportsbook, or gambling service. We do not process any gambling transactions.

References to casino operators, software providers, or payment processors exist purely for informational comparison. They do not constitute endorsements.

We do not guarantee that every piece of information on the Platform is accurate, complete, or current. This includes User reviews, operator details, bonus terms, licensing data, and regulatory status. Always verify key facts independently before making decisions.

5. Account Registration and Security

Certain features of the Platform, including the submission of reviews and participation in discussions, require registration of a User account. By registering, you agree to:

  • Provide accurate, current, and complete information during the registration process;
  • Maintain the confidentiality of your login credentials and not share them with any third party;
  • Accept sole responsibility for all activities conducted under your account;
  • Notify the Operator promptly of any unauthorised access to or use of your account.

The Operator reserves the right to refuse registration, suspend access, or terminate any account at its sole discretion where it reasonably believes that a User has provided false information or has violated these Terms.

6. User Content: Licence, Standards, and Responsibility

By submitting Content to the Platform, you grant the Operator a non-exclusive, worldwide, irrevocable, royalty-free licence to use, reproduce, display, distribute, and create derivative works of such Content in connection with the operation of the Platform and related promotional activities. You retain ownership of your Content but acknowledge that published reviews and comments will be displayed publicly and may be indexed by third-party search engines.

You represent and warrant that any Content you submit:

  • Is truthful and based on your genuine personal experience;
  • Does not contain statements that are knowingly false, misleading, or defamatory;
  • Does not contain hate speech, threats of violence, harassment, or discriminatory language;
  • Does not disclose personal data of any third party without their prior consent;
  • Does not constitute unsolicited advertising, spam, or promotional material unrelated to casino experiences;
  • Does not infringe upon the intellectual property rights, privacy rights, or any other legal rights of any third party.

You acknowledge that you are solely responsible for the Content you submit and that the Operator shall not be liable for any claims, losses, or damages arising from User-generated Content.

7. Moderation and Editorial Discretion

All User Content is subject to moderation prior to publication. The Operator reserves the right, but does not assume the obligation, to review, edit, refuse, or remove any Content that, in its sole judgement, violates these Terms, applicable law, or the Platform's content guidelines. The Operator is not required to provide reasons for individual moderation decisions and shall not be liable for any delay or failure to publish any particular submission.

The Operator does not alter the substantive meaning of User reviews. Editorial adjustments, where made, are limited to formatting, grammar, or the removal of prohibited content as outlined in Section 6 above.

8. Casino Representative Accounts

Casino operators may apply for Representative Accounts to respond to User reviews concerning their services. All Representative Account applications are subject to manual verification by the Operator. Approved representatives may respond to reviews related to their casino but are expressly prohibited from:

  • Submitting reviews, whether favourable or unfavourable, for any casino, including their own;
  • Attempting to manipulate ratings, review scores, or User perceptions through deceptive means;
  • Engaging in harassment, intimidation, or retaliatory conduct toward Users who have submitted reviews.

Representative responses are clearly labelled as originating from the casino operator and do not affect the review score or its position on the Platform. Violation of any of these restrictions shall result in immediate revocation of the Representative Account without prior notice.

9. Intellectual Property

The design, layout, underlying source code, databases, and all original editorial content of the Platform are the property of the Operator and are protected by applicable copyright, trademark, and intellectual property legislation. No part of the Platform may be reproduced, distributed, modified, or used for commercial purposes without the prior written consent of the Operator.

Third-party trademarks, logos, and brand names appearing on the Platform remain the property of their respective owners. Their inclusion on the Platform is solely for the purpose of identification and informational commentary and does not imply affiliation, endorsement, or sponsorship.

10. Limitation of Liability

To the fullest extent permitted by applicable law, the Operator, its directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with:

  • Your use of, or inability to use, the Platform;
  • Any reliance placed on information, reviews, ratings, or other Content published on the Platform;
  • Any interaction, transaction, or dispute between you and any casino operator, software provider, or other third party referenced on the Platform;
  • Unauthorised access to or alteration of your data or transmissions;
  • Any errors, inaccuracies, or omissions in the Content or any loss or damage incurred as a result thereof.

The Platform is provided on an "as is" and "as available" basis. The Operator makes no representations or warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Operator, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

12. Privacy and Data Protection

The processing of personal data in connection with the Platform is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Platform, you acknowledge that you have read and understood the Privacy Policy and consent to the collection, use, and processing of your personal data as described therein, in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation) and applicable national data protection legislation.

13. Third-Party Links and Services

The Platform may contain hyperlinks to websites or services operated by third parties. The Operator does not control, and is not responsible for, the content, privacy practices, or availability of such third-party resources. The inclusion of any link does not imply endorsement of the linked site. Your use of third-party websites is at your own risk and is subject to the terms and conditions of those websites.

14. Termination

The Operator may suspend or terminate your account and your access to the Platform at any time, with or without cause, and with or without prior notice. Grounds for termination include, but are not limited to, violation of these Terms, suspected fraudulent activity, or conduct that the Operator reasonably considers harmful to other Users or to the integrity of the Platform.

You may request deletion of your account by contacting the Operator through the contact page. Upon termination, your right to access and use the Platform shall cease immediately. Provisions of these Terms that by their nature should survive termination (including, without limitation, Sections 6, 9, 10, 11, and 15) shall continue in full force and effect.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Malta. Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform shall be submitted to the exclusive jurisdiction of the courts of Malta, without prejudice to any mandatory consumer protection provisions that may apply under the law of your country of habitual residence.

Nothing in this clause shall prevent the Operator from seeking injunctive or other equitable relief in any court of competent jurisdiction where such relief is necessary to protect the Operator's rights or property.

16. Severability

If any provision of these Terms is found by a court or tribunal of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from these Terms to the extent of such invalidity or unenforceability, and the remaining provisions shall continue in full force and effect.

17. Waiver

No failure or delay by the Operator in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any such right, power, or remedy preclude any further or other exercise of that or any other right, power, or remedy.

18. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published on the Platform, constitute the entire agreement between you and the Operator with respect to your use of the Platform and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
